What transfers with a farm sale is one of the most common points of confusion, because the line between what stays with the land and what the seller takes is not always obvious. Permanent infrastructure — irrigation systems, fencing, barns, shops, drainage tile, and grain bins that are affixed — generally stays with the property as a fixture, while movable equipment like tractors, implements, and portable structures are chattels the seller keeps unless the contract says otherwise.

Where it gets contentious is the grey area: a removable irrigation system, a bolted-down but separately purchased piece of equipment, or a portable greenhouse. The contract has to list exactly what is included and what is excluded, because a buyer who assumes the irrigation comes with the land and a seller who plans to take it can end up in a dispute at closing. Quota, where it exists, is a separate asset entirely and never transfers with the land unless the contract and the marketing board say so.

I make sure the listing and the contract are explicit on inclusions and exclusions before the offer is accepted, because ambiguity here is one of the most common and costly farm-sale disputes. Read our Selling a Farm guide for the framework, and have your lawyer draft the inclusions precisely before you sign.

ALR rules, water licensing, zoning and farm-classification requirements can change and depend on your specific property.
